CNBLUE fined 15 million won for unauthorised use of Crying Nut’s “Offside” in a performance

After a long legal battle,a court has fined CNBLUE and FNC Entertainment for the unauthorised used of Crying Nut’s track. 

On February 3rd, Seoul Central District Court ruled that CNBLUE and their agency FNC Entertainment are guilty of using Crying Nut’s world cup support track “Offside” without authorisation and is ordered to pay 15 million won in indemnities.

The judge preceding the ruling stated that CNBLUE used Crying Nut’s “Offside” track as back recordings for an aired performance without the permission of the independent band on Mnet’s M! Countdown back in 2010. The controversy further received heat after the said performance was included in CNBLUE’s DVD release in Japan. In their initial complaint, Crying Nut emphasised that there has been a copyright violation against them.

Although Crying Nut received compensation from the said broadcasting agency after the incident, FNC Entertainment was held responsible for failing to obtain authorisation for the said performance, which led to a legal battle between the two parties that lasted for at least five years.
